Terms and Conditions

Participation in the giveaway by THE Branding Newsletter, hereinafter referred to as the operator or organizer, is free of charge and is exclusively governed by these terms and conditions.

Duration of the Giveaway

The giveaway runs from May 3, 2024, 00:01 AM to May 12, 2024, 11:59 PM. During this period, users have the opportunity to participate in the giveaway online.

Participation

To participate in the giveaway, registration and confirmation of subscription to THE Branding Newsletter at www.brandingnewsletter.com are necessary. Both already registered subscribers and new registrations within the participation period are eligible for the giveaway. Registrations received after the end of the participation period will not be considered.

Each participant can enter the giveaway with only one submitted registration. Using multiple email addresses to increase the chances of winning is prohibited. Participation in the giveaway is free of charge.

Eligibility

Natural persons who are residents of Germany and have reached the age of 14 are eligible to participate. The giveaway is not limited to customers of the organizer and is not dependent on the purchase of goods or services. If a participant is restricted in their legal capacity, the consent of their legal representative is required. Persons involved in the conception and implementation of the giveaway, as well as employees of the operator and their family members, are not eligible to participate. The organizer reserves the right to exclude persons from participation at its own discretion if there are justified reasons, such as (a) manipulation in connection with access to or conduct of the giveaway, (b) violations of these terms and conditions, (c) unfair conduct, or (d) false or misleading statements in connection with participation in the giveaway.

Prize, Notification, and Delivery

The following prize will be awarded: 1x Apple AirPod Max

The winner will be determined after the closing date in a random drawing among all participants. If the giveaway is linked to a task, only those participants who have correctly completed the task will be entered into the drawing. The winner will be informed about the prize shortly via a separate email.

The prize will only be handed over directly to the winner or to the legal representative of the minor winner. Exchange, self-collection, and cash payment of the prize are not possible.

Any costs associated with the shipping of the prize will be borne by the operator. Additional costs associated with the claim of the prize will be borne by the winner. The winner is responsible for any taxation of the prize.

If the winner does not respond within a period of 1 week, the prize may be transferred to another participant.

Termination of the Giveaway

The organizer expressly reserves the right to terminate the giveaway without prior notice and without stating reasons. This applies in particular to any reasons that would disrupt or prevent a planned course of the giveaway.

Data Protection

Participation in the giveaway requires the provision of personal data. The participant assures that the personal information provided, especially first name, last name, and email address, is truthful and correct.

The organizer points out that all personal data of the participant will not be disclosed to third parties without consent, nor will it be used by them.

In the event of a win, the winner agrees to the publication of his name in the advertising media used by the organizer. This includes the announcement of the winner on the operator’s website and its social media platforms.

The participant may revoke their consent at any time. The revocation must be sent in writing to the contact details of the organizer provided in the imprint section of THE Branding Newsletter. Upon revocation of consent, the collected and stored personal data of the participant will be deleted immediately.

Applicable Law

Questions or complaints in connection with the giveaway should be addressed to the operator. Contact details can be found in the imprint section. The organizer’s giveaway is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.

Severability Clause

Should any provision of these terms and conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. Instead of the invalid provision, that legally permissible regulation which comes closest to the economic intent and purpose expressed in the invalid provision shall apply. The same applies in the event of a loophole in these terms and conditions.
